Buying from the Website

  1. You acknowledge and warrant to Dyson that:
    1. you are an Australian resident aged 18 years or over;
    2. you will be liable for all costs, fees, charges and other amounts which may become payable to Dyson as a result of your use of this website;
    3. you are not breaching any requirement of any applicable law relating to the privacy of personal information by providing the information to Dyson; and
    4. all information (including credit card details) you provide to Dyson is true and complete.
  2. Your telephone order or on-line purchase order (as applicable) is an offer to buy from Dyson. All Australian orders should include a daytime delivery address and contact details. Dyson reserves the right not to accept an order at its sole discretion.
  3. By providing your details, you consent to receiving related communications from us, including confirmation that the order has been received by Dyson. Confirmation of the order does not constitute acceptance of your order. Dyson reserves the right at any time after receipt of your order to accept or decline your order for any reason (including stock run out), regardless of whether your order has been confirmed or your credit or debit card has been charged or paypal has been cleared. If your order is declined or cancelled by Dyson after the payment for the purchase, Dyson will promptly refund your payment to the credit or debit card or method you originally used for the purchase.
  4. Payment for the goods which you order must be made either by credit or debit card issued by Mastercard or Visa, or Paypal. Your credit or debit card, or Paypal will be charged at the time of Dyson receiving your order and prior to the time that the goods are dispatched and received by you. Dyson will provide you with an invoice number as confirmation of the order. If your payment is rejected by the card issuer your order will not be dispatched. Payment is made at your own risk.
  5. If you pre-order for the goods, order goods which are currently out of stock, or book a delivery slot in advance, Dyson and its payment partners will authorise or reserve a charge on your credit or debit card, or Paypal for any amount up to the full value of the goods at any time between the order being placed and the goods being delivered. If the authorisation has expired or for any reason has failed, Dyson reserves the right to re-authorise up to the full amount, either before or after dispatch of the goods. In which case, Dyson will notify you via the email address provided during checkout. If Dyson does not receive re-authorisation from your credit or debit card issuer, or Paypal, then Dyson will contact you so that you can provide Dyson with another payment method. If in the unlikely event that the price increases from when it was originally ordered, Dyson will contact you 7 days before requesting re-authorisation from your credit or debit card issuer, or Paypal.
  6. The price of the goods (including for parts and accessories) (inclusive of GST), the applicable delivery costs and availability of the goods displayed on this website are subject to change without notice. The title to goods will only pass following payment in full.
  7. Delivery dates of the goods are intended to be an estimate only.
  8. Orders will only be accepted from and dispatched to street addresses in Australia.
  9. Orders will be delivered by post and we aim to have the goods delivered to you within 5-7 days of the acceptance of your order, subject to availability of stock. Delivery of the products may be totally or partially suspended by Dyson during any period in which Dyson may be prevented or hindered from delivery by its normal means of delivery or supply through any circumstances outside its reasonable control, including but not limited to strikes, lockouts, unavailability of stock, accidents or breakdowns of plant or machinery. Dyson will not be liable for any damages not reasonably foreseeable arising from its failure to deliver any or all of the products.
  10. Any failed delivery attempt due to incorrect details provided by you must be paid for by you. Subsequent delivery attempts may incur additional delivery charges.
  11. To the fullest extent permitted by applicable law, Dyson (including its employees, officers, agents and contractors) makes no representations about the materials contained on this website or any websites linked to this website.
  12. To the fullest extent permitted by applicable law, Dyson (including its employees, officers, agents and contractors):
    1. is not liable to you or anyone else for any loss or damage, however caused (including negligence), which may suffered be directly or indirectly, in connection with use of this website including but not limited to interference with or damage to your computer systems; and
    2. excludes liability (whether that liability arises under contract, tort (including negligence) or statute) for any special, indirect or consequential loss or damage (including without limitation loss of revenue and loss of, or damage to, data) suffered or incurred in connection with this website.
  13. The Australian Consumer Law provides for statutory guarantees that cannot be excluded by law. The limitations outlined in clause 11, and anywhere else in those document, will not operate to the extent they are inconsistent with those statutory guarantees.

    Dyson may vary these terms and conditions at any time. Any variations become effective on posting. By making a purchase through this site after the terms and conditions have been varied, you agree to be bound by the variation.
  15. You may cancel your order at any time up to 14 days after receiving the goods by notifying us in writing either by:

    You must return the goods, unused and sealed in their original packaging to: Dyson Accessories, 8-10 Mangrove Lane, Taren Point NSW 2229. Please contact us via phone on 1800 239 766 or email at aucustomercare@dyson.com prior to return and we will provide details on how to return, including an Australia Post returns label with tracking number to cover postage. Note that if you fail to take reasonable care of the goods we might not be able to accept their return. Otherwise, we will refund the full purchase price to you. 

    If your goods are being returned for a defect, please contact us prior to return. We will provide details on how to return, including a reply paid number to cover postage.

  2. To be eligible to claim the offer, you must have purchased an eligible Dyson product from Dyson:

    2. by phone from Dyson’s customer contact centre.

  3. Subject to your rights under Australian Consumer Law, where a presentation case has been personalised, a refund cannot be claimed under this offer.
  4. To be eligible to claim under this offer: (i) the product must have been used under normal household conditions and maintained according to the instructions supplied; and (ii) you must produce such evidence as is reasonably required by Dyson to establish that the product is not subject to any hire purchase, lease, rental or other agreement, a result of which being that another party has an interest in or charge over the product.
  5. To be eligible for a refund under this offer, you must contact Dyson’s customer care centre by phone at 1800 239 766 or email at aucustomercare@dyson.com and lodge your claim within 45 days of purchase. 
  6. Dyson reserves the right to verify the validity of all claims made in connection with this offer.  If your claim is assessed as valid, Dyson will provide you with instructions on how to return your machine to Dyson’s Australian premises (address below).  Dyson will cover the cost of the courier of the product within Australia.
  7. The product, all accessories and any gifts or bonus products must be returned undamaged, in full working order, in original packaging and with original proof of purchase.
  8. Dyson has absolute discretion to determine whether these Terms and Conditions have been satisfied entitling you to a refund under this offer.
  9. If authorised by Dyson, allow 45 days to receive the refund from the date of authorisation.
  10. This offer is in addition to, and does not exclude, restrict or modify, any rights you have under the Australian Consumer Law.

Best Price Policy

  1. Information on the Dyson Best Price Policy and how to claim forms part of these Terms and Conditions. By participating in this offer, you accept these Terms and Conditions. 
  2. If you find a Dyson product that is available from Dyson at www.dyson.com.au (Website) advertised at a lower price by a National Retailer (as defined in section 3), Dyson will match that advertised price subject to these Terms and Conditions.
  3. National Retailers are the following Australian retailers: Harvey Norman, Bing Lee, The Good Guys, JB Hi-Fi, Big W, Costco, Shaver Shop, David Jones and Myer. Dyson may, in its discretion, add other retailers to the National Retailers by updating these terms and conditions and publishing them on the Website.
  4. Comparative product must be in stock and readily available for sale at a retail outlet [or online from a National Retailer and be the identical model to a Dyson product available on the Website.
  5. Comparative product must be new and in original packaging. Reconditioned, refurbished, display, demonstrator or damaged products, as well as products available for purchase at a Dyson warehouse sale are excluded.
  6. Price match not available where National Retailer’s lower price is due to member-only offers, corporate reward programs or employee discounts. 
  7. You must provide satisfactory proof of current advertised price of the comparative product by a National Retailer to Dyson (eg. flyer, catalogue, website URL or email).  Proof must be verifiable by Dyson and price must be stated in Australian dollars.  Verbal and written offers are excluded.
  8. Where National Retailer’s lower price is due to an error in advertising (theirs or Dyson’s), this is excluded. 
  9. Dyson reserves the right to limit the quantity of a product available for purchase under the Best Price Policy by a customer, at its discretion.

  1. Information on how to claim and Dyson’s offers in connection with the Dyson Bounty Bag offer forms part of these Terms and Conditions. By using the promotional code received by you in connection with Dyson Bounty Bag offer, you accept these Terms and Conditions and the terms and conditions on the Dyson Bounty Bag off leaflet (including the promotional code) provided to you by Dyson.
  2. A promotional code issued to you is valid during the specified time period and on the terms and conditions set out in the Dyson Bounty Bag offer leaflet provided to you.

Dyson Soft Roller Cleaner Head Bonus Gift – with the purchase of the Dyson V8 Animal vacuum (as set out below) from 24 February until 12th March 2020 (while stocks last).

  13. The Promoter’s decision is final and no correspondence will be entered into.
  14. The first valid entry drawn at random in each Monthly Draw will each win a Dyson Cyclone V10™ vacuum valued at (RRP) $999.00. The prize will be delivered to the winner’s nominated residential address in Australia.

  13. The best valid entry as determined by the judges in each Entry period, will each win a Dyson V10 Absolute+ vacuum demonstration by a Dyson Hit Squad team (each a “Demo”). The Promoter will award each winner with either a Car Demo or a Venue Demo which will be determined by the Promoter in its absolute discretion at the time of winner notification. Each Demo must take place within 30 days of the close date for the relevant Entry Period in which the winner was selected (however no earlier than 48 hours after the winner has been selected). Each Demo must take place at a location (within 25km of Sydney/Melbourne CBD) to be determined in agreement with the winner and the Promoter. In event an agreement cannot be reached, the Promoter reserves the right to determine the location of the Demo. No caked in mess will be cleaned up by the Dyson Hit Squad. No mess on the outside of the car will be cleaned up by the Dyson Hit Squad. The winner must organise a minimum of ten (10) people to attend the Demo. The Dyson Hit Squad will only remove the following type of debris/mess: loose crumbs, dirt, sand and small leaf matter that is within the confines of the venue. The Dyson Hit Squad will only remove up to six (6) full bins of mess (bins being the ones that are attached to the vacuum). Each Demo shall not exceed one (1) hour in duration, however the Dyson Hit Squad reserve the right to finish the Demo at any point.
  16. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  17. Dyson Hit Squads reserve the right to decline to clean any items that they deem are unsafe, may damage the Dyson V10 Absolute+ vacuum or are inappropriate in nature.
  18. Winners must be willing for the Dyson Hit Squad Demo to be recorded/filmed and subsequently shared on social media, this includes but is not limited to photos and recordings of the Demo taking place and the Dyson Hit Squad interacting with any attendees at the Demo.
  19. If for any reason the winner does not take / redeem a Demo prize at/by the time stipulated by the Promoter, then the Demo prize will be forfeited.
  20. If the Demo prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Demo prize with a prize to the equal value and/or specification.

By using the promotional code received by you in connection with the Dyson Academy, you accept these Terms and Conditions and the terms and conditions on the promotional card (including the promotional code) provided to you by Dyson.

1.3.  Entry is only open to Australian residents over the age of 18, that currently reside in NSW, VIC, QLD, WA, TAS, NT, SA or ACT, and that are not excluded by clause 1.5 of these terms and conditions, below, and that currently own a Dyson fan or fan heater (Eligible Participant).

1.4.  By entering and/or participating in the Competition, each Eligible Participant agrees to abide and be bound by these Terms and Conditions.

1.5.  The following people are not eligible to participate in the Competition: (a) directors, officers and employees of the Promoter or Nectar & Co Pty Ltd (ABN 15 167 901 957) (the Agency) and each of their related companies; (b) directors, officers and employees of contractors to the Promoter or the Operator; and (c) immediate family of persons falling into the categories under (a) and/or (b). For the purposes of these Terms and Conditions, ‘immediate family’ means spouse (including de facto), parent, child and stepchild.

2. Term of Competition

The Competition commences at 9:00 AM (AEDT) on 28th June 2019 and ends at 11:59 PM (AEDT) on 28th July 2019 (the Competition Period).

3. How to Enter

An Eligible Participant may enter the competition by completing an online questionnaire provided by the Agency, including telling Dyson in 25 words or less how they think their Dyson fan or fan heater has changed their life (the Fan & Heater Survey). If a participant provides their full name, email address, and residential details as part of the Fan & Heater Survey they will be entered into the competition for the opportunity to win the Prize as defined below.

By entering this competition, entrants give their express permission to be contacted by the Promoter or its agent in relation to this competition.  All entries become the property of the Promoter.

The Promoter will not be liable for any loss or damage whatsoever resulting from incorrect details being provided by entrants.

4. Selection of Winner

Ten (10) Eligible Entrants will be selected (Winners) based on the final entry question only ‘In 25 words or less, please tell us how you think your Dyson fan or fan heater has changed your life?’ on 1st August 2019 at 5:00 PM (AEDT) at the Promoter’s office located at Shed72 4F Huntley St, Alexandria NSW.  The Promoter will judge each entry based on the following criteria: (a) creativity; (b) ingenuity; (c) knowledge of Dyson products.

5. The Prize

5.1.  Ten (10) winners will receive each receive a $100 Visa gift card. The Eligible Entrants acknowledge that such gift cards are subject to terms and conditions set by the gift card issuer.

5.2.  Prize Specific Conditions:  (a) The Prize must be taken as offered and cannot be varied or redeemed for cash. The Prize value is GST inclusive, is in Australian dollars. (b)  If due to circumstances outside of Promoter’s control, Promoter is unable to provide the stated Prize, the Promoter reserves the right to award substitute prizes of equal value.  The Prizes are subject to the Promoter’s terms and conditions. (c) The Prize cannot be transferred. (d) The Prize will be valid for a limited period as set by the gift card issuer.

6. Prize Winner Notification

6.1.  The Winners will be notified by phone and/or email by 5.00 PM (AEDT) on 2nd August 2019.

6.2.  The Winner must contact the Promoter to confirm delivery details of the prize.

7. Tax

Any taxes which may be payable as a consequence of the Winner receiving the Prize are the sole responsibility of the Winner. The Promoter encourages the Winner to seek independent financial and tax advice about any tax implications that may arise from the Prize winnings.

8. Exclusion of Liability

8.1.  To the extent permitted by law, the Promoter is not liable for any loss, including, but not limited to, direct, consequential (including economic) or indirect loss or any loss of profits, by reason of any act or omission, deliberate or negligent, by the Promoter or their servants or agents, in connection with this Competition or the arrangement for supply, or the supply or failure to supply, of any goods or services by any person to a Winner.

8.2.  Nothing in these Terms and Conditions affect, nor is intended to affect, any rights that an Eligible Participant might have that are not able to be excluded under applicable Australian laws, including the Australian Consumer Law.

9. Unclaimed Prize Draw

9.1.  If the Winner does not notify the Promoter by 5:00 PM (AEST) on 15 August 2019 (clause 6.2), an unclaimed prize draw will be conducted at 10:00 AM (AEST) on Wednesday, 16 August 2019at the Promoter’s New South Wales Office (the Unclaimed Prize Draw). The Unclaimed Prize Draw will be conducted in the same manner as detailed in clause 4 of these Terms and Conditions.

9.2.  The Winner of the Unclaimed Prize Draw (the Supplementary Winner) will be notified by phone and email by 5.00 PM (AEST), 16 August 2019.

9.3.  The Supplementary Winner will have until Friday 23 August 2019 to contact the Promoter and confirm their details. If the Supplementary Winner has not confirmed such details with the Promoter by this date, the Prize will be forfeited, cash will not be awarded and no further Unclaimed Prize Draw will take place.

10. Other

10.1.    These Terms and Conditions are governed by the laws in force in New South Wales during the period of the Competition and Participant agrees to irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales or any other court having jurisdiction in Australia as may be nominated by Promoter.

10.2.    In order to participate in the competition, entrants must provide certain personal information to the Promoter and/or the Agency on behalf of the Promoter.  The personal information collected via the Fan & Heater Survey is collected and processed only for the purposes of organising, running and monitoring this Competition. 1. General Entry
